LA County Mandates Covid-19 Vaccine for Certain Businesses

Starting October 7, 2021, Los Angeles County Employers join Contra Costa and San Francisco Counties in mandating Covid-19 vaccines of patrons and all on-site employees working in public indoor bars, wineries, breweries, nightclubs and lounges. These new Orders are due to the continual uptick in Covid-19 cases seen in Los Angeles County.

What does this mean for your business? The Los Angeles County Department of Health announced a new Order which now requires proof of the Covid-19 vaccine to enter, or work, at these establishments.  Employers need to ensure that their communications and policies to their staff, as well as their patrons, is clearly outlined for indoor use. (If you do not have proof of vaccination, you may still be able to get service outdoors, or pick up curbside.)  While strongly recommended by the LA Public Health Department that restaurants or food facilities reserve and prioritize indoor seating/service for those fully vaccinated, the Order stopped short of requiring this by these businesses.

When do I have to be vaccinated by? Proof of the first dose must be shown to Los Angeles County employers by October 7, 2021 and full vaccination will be required by November 4, 2021.  Remember, you are not considered “fully vaccinated” until two weeks after the last dose of the vaccine was received.   As always, there are exceptions to this mandate due to qualifying medical reasons or a sincere religious belief, and still a mask mandate in effect regardless of vaccination status across California.

Employers also need to implement a system with which to verify their employees are actually fully vaccinated, understand what is acceptable proof of the Covid-19 vaccine, including the digital vaccine record, which you obtain easily and keep handy on your cell phone for easy access into venues requiring vaccine proof.

This is just another reminder, that the best way to reduce transmission of the Coronavirus is to get fully vaccinated as soon as you can.  For more information on this mandate in Los Angeles, or other counties, how to ensure you are obtaining proper proof of vaccination and to implement the best policy for your workplace, please contact the Employer Lawyers at Chauvel & Glatt.
