COVID-19 Update: Families First Coronavirus Response Act

Attention Employers! On March 18, 2020, Congress passed the Families First Coronavirus Response Act (“Act”) designed to blunt the impact of employees affected by COVID-19 who would otherwise not get paid under regular circumstances.

The Act, which takes effect on April 2, 2020, requires all public employers and private employers with less than 500 employees, to provide all employees with Emergency Paid Sick Leave and other paid leave of absences related to COVID-19.   While the Department of Labor is still working on ironing out exemptions and a model notice which all businesses will be required to post, employers need to make sure that they take action with proper legal advice to prevent potential claims that could arise.
