When a family member passes away, the execution of his or her living trust (if there is one) begins, under the administration of the previously appointed trustee. Conflicts can arise between beneficiaries, or between the trustee or other fiduciary and beneficiaries, especially if there is a large amount of assets involved.

There are also times when your loved one is physically incapable of making financial decisions. Who makes these decisions then?   Is there a “Power of Attorney” in existence? Unfortunately, disputes can take place between “power of attorney” and other family members over the myriad of decisions that transpire in order to take care of your loved one.
